This Privacy Policy describes policies and procedures of Shoutz, Inc. on the collection, use and disclosure of your information as a user of the Shoutz applications, including LotteryHUB (apps), platform (infrastructure), and websites or sections of third party websites (www.shoutz.com, www.lotteryhub.com, www.twitter.com/Shoutz, www.twitter.com/LotteryHub, www.facebook.com/shoutzinc, www.facebook.com/lotteryhub, any Shoutz branded or supported game (currently Play and Win™ and Shake and Win™, herein, the “Games”) and our SMS, APIs, and other services (collectively, the “Services”). As used in this document, the capitalized terms “Shoutz,” “we,” “us,” or “our” refer to the company, Shoutz, Inc., a Delaware corporation based in Austin, Texas. When the term “shoutz” is used with a lower case “s”, this term refers to a short form video and relates Content displayed on the Services.

Our Privacy Policy explains how Shoutz and some of third party contractors (i.e. “Cloud” service providers, advertisers and advertising networks, clients, and promotional service providers) collect, use, share and protect information in relation to the Services, and your choices about the collection and use of your information. By using the Service you understand and agree that we are providing a platform for you to view, post content, comments and other materials (collectively, “User Content”), to the Services and to share our Content and User Content publicly. When using any of our Services, and as a condition of using those Services, you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy. Irrespective of which country that you reside in or create information from, we may use your information in the United States or any other country where Shoutz operates. This means that other Users may search for, see, use, or share any of your User Content that you make publicly available through the Service, consistent with the terms and conditions of this Privacy Policy and our Terms of Service (which can be found at http://www.shoutz.com/terms-of-use or http://lotteryhub.com/terms-of-use.php. This Privacy Policy applies to all visitors, users, and others who access any one or more of the Services (“Users”).

Information Collection and Use

We collect, or may collect in the future, one or more types of the following information:

Information Users Provide During Registration: When you initially register and/or create an account on any the Services, you provide some personal information, such as your name, username, password, and email address and/or mobile telephone number. Some of this information may be or become available publicly on our Services, including on any profile page. Some Services do not require registration or the creation of an account (but we reserve the right to require registration or an account in the future).

Additional Information: You may provide us with additional information to make public, depending on features on the Services offered by us from time to time, such as a short biography or description, your location, a picture or a shoutz. You may customize your account with information such as a cell phone number for the delivery of SMS messages or your address book so that we can help you find other users of the Services you know. We may use your contact information to send you information about our Services or to market to you. We will use your contact information to provide Service-related communications between you and us. For example, we may send you Service-related emails (e.g., account verification, changes/updates to features of the Service, technical and security notices). Note that you may not opt out of Service-related emails. However, you can unsubscribe from marketing messages by following the instructions contained within the message. If you email us, we will keep your message, email address and contact information to respond to your request. Providing the additional information described in this section is entirely optional on your part.

Finding or Communicating with Your Friends: We may, but are not obligated, to allow you to share certain of your activities on the Services or to “invite friends” or otherwise communicate to third parties through one or more third party social media sites or through your contacts list. If offered, and if you choose to find your friends through your device's contacts list, then we will access your contacts list to determine whether or not someone associated with your contacts is using the Services. If you choose to find your friends through a third-party social media site, then you will be prompted to set up a link to the third-party service and you understand and agree that any information that such third-party social media site provides us will be governed by this Privacy Policy. If you choose to invite someone to the Service through any "invite friends" feature, you may select a person directly from the contacts list on your device and send a text or email from your personal account. You understand and agree that you are responsible for any charges that apply to communications sent from your device, and because this invitation is coming directly from your personal account, Shoutz does not have access to or control this communication.

Shoutz, Following, Joining, Lists and other Public Information: In using our Services, some of the information you provide to us is by necessity going to be made public. This includes shoutz you make and similar messages but also any metadata you provide to us. Metadata is usually technical data that is associated with User Content. For example, metadata can describe how, when and by whom a piece of User Content was collected and how that content is formatted. Mostly, however, the information that is made public will consist of the lists you create, the people, companies or brands you follow, the shoutz you mark as favorites or share, and many other bits of information. Your public information is broadly and instantly disseminated. For example, your shoutz are searchable by many search engines and may be immediately delivered via SMS and our APIs to a wide range of users and services. You should be careful about all information that will be made public by your use of the Services, not just your individually created shoutz.

Location Information: You may choose to note your location in your individually created shoutz and in your profile. In the future we may add geolocation services to the Services and at such time we will ask you to allow us to use this information. You may opt out of allowing us to use location information (although a number of the Services will not be available to Users who opt out of geolocation services). However, if you turn this feature on, we may also save exact coordinates to help improve our service. You will be able to control your location information settings in your account settings on the Services.

Other Data

Device identifiers:

When you use a mobile device like a tablet or smartphone to access our Service, we may access, collect, monitor, store on your device, and/or remotely store one or more "device identifiers." Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device's operating system or other software, or data sent to the device by us. A device identifier may deliver information to us or to an advertiser or third party partner about how you access and use the Services and may help others or us provide reports or personalized content and advertisements. Some features of the Service may not function properly if use or availability of device identifiers is impaired or disabled.

Log Data:

Log file information is automatically reported by your browser each time you make a request to access (i.e., visit) a web page or app. It can also be provided when the content of the web page or app is downloaded to your browser or device. When you use the Services, our servers automatically record certain log file information, including your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Services, domain names, landing pages, pages viewed, and other such information. We may also collect similar information from emails sent to our Users which then help us track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Services.

We may use third-party analytics tools to help us measure traffic and usage trends for the Services. These tools collect information sent by your device or our Services, including the pages and channels you visit and other information that assists us in improving the Service. We collect and use this analytics information with analytics information from other Users so that it cannot reasonably be used to identify any particular individual User.

Cookies and similar technologies:

We will from time to time use cookies and similar technologies like pixels, web beacons, and local storage to collect information about how you use the Services in order to better provide features to you. We may ask advertisers or other partners to serve ads or services to your devices, which may use cookies or similar technologies placed by the third party or us.

Links:

Shoutz will track of how you interact with links and advertisements in Shoutz across our Services including third party services and our advertisers and clients. We do this to help improve our Services, including advertising, and to be able to share various data statistics generated by this use of the Services.

Third Party Services:

Shoutz uses a variety of services hosted by third parties to help provide our Services and to help us understand the use of our Services. These services may collect information sent by your use of the Services.

Information Use, Sharing and Disclosure

Use.

In addition to the other uses we describe in this Privacy Policy, we may use information that we receive from you or your use of the Services to:

  • help you efficiently access your information after you sign in
  • remember information so you will not have to re-enter it during your use of the Services or the next time you use the Services;
  • provide personalized content and information to you and others, which could include advertising or other promotions, or other forms of marketing
  • provide, improve, test, and monitor the effectiveness of our Service
  • develop and test new products and features
  • monitor metrics such as total number of visitors, traffic, and demographic patterns
  • diagnose or fix technology problems
  • automatically update the apps on your device

Sharing and Disclosure.

We will not disclose your private information except in the limited circumstances described here.

Your Consent: We may share or disclose your information with your consent, and these instances and scope and limits of that sharing will be communicated to you during use when those occasions arise.

Service Providers: We engage certain trusted third parties to perform functions and provide services to us. We may share your personal information with these third parties, but only to the extent necessary to perform these functions and provide such services, and only pursuant to obligations supporting the protections of this privacy policy.

Law and Harm: We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

Business Transfers: In the event that Shoutz is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, or similar transaction, your information may be sold, transferred or assigned, in whole or in part, as a part of that transaction. The promises in this Privacy Policy will apply to your information as transferred to the new entity.

Non-Private or Non-Personal Information: We may share or disclose your non-private, aggregated or otherwise non-personal information, such as your shoutz or the number of times you used a specific aspect of the Services.

Storage and Processing

Your information collected through the Services may be stored and processed in the United States or any other country in which we, our affiliates or our Service Providers maintain facilities. Shoutz, its affiliates, or service providers may transfer information that we collect about you, including personal information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. By registering for and using the Services you consent to the transfer of information to the U.S. or to any other country in which Shoutz, its affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

We use commercially reasonable safeguards to help keep the information collected through the Services secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, Shoutz cannot assure you that the security of any information you transmit to Shoutz, or Shoutz’s security mechanism in general, is absolute, perfect, foolproof or incapable of being accessed in an unauthorized way. Shoutz cannot guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed.

Please do your part to help us. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and us, at all times. Your privacy settings may also be affected by changes made to the services any of the social media services you use connect to the Services. We are not responsible and disclaim any liability for the functionality, privacy, or security measures of any other organization.

Modifying Your Personal Information

If you are a registered user of our Services, we provide you with tools to access or modify the personal information you provided to us and associated with your account.

You can also permanently delete your account. If you follow the instructions on the support page or settings sections of the apps, your account will be deactivated and then deleted. When your account is deactivated, it is no longer viewable on the Services or on the apps. For up to thirty days it is still possible to restore your account if it was accidentally or wrongfully deactivated. After thirty days, we begin the process of deleting your account from our systems.

Our Policy Towards Children

Persons younger than 13 years of age may not use our Services. If you become aware that your child has provided us with personal information without your consent, please contact us at privacy@shoutz.com. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate and delete the related account.

How To Contact Us About A Deceased User

In the event of the death of a User, please send us an email to the following email address: support@shoutz.com. We will usually conduct our communication via email; should we require any other information, we will contact you at the email address you have provided in your request.

Changes to this Policy

We may revise this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our use of your information and will always be located and available at http://www.shoutz.com/privacy-policy and http://www.lotteryhub.com/privacy-policy.php. If we make a change to this policy that, in our sole discretion, is material, we will notify you an email to you to the email associated with your account. By continuing to access or use the Services after receipt of notice of those changes, you agree to be bound by the revised Privacy Policy.
